LICENSE AGREEMENT FOR MARRIAGE PROPOSAL AND FURTHER RELATIONSHIP
IMPORTANT-READ CAREFULLY: This License Agreement ("License" or Agreement) is a legal agreement between You (either an individual or an entity, who will be referred to in this License as "You" or Your) and Myself [KESAVAN M] for the developing new relationship between us denoting either at entity level and/or family level, and which may include associated groups, their members, and other relations but not limited to marriage relation ("Relation"). The relation also includes any updates and upgrades of the same that Myself and the opposite party develop by mutual understanding and/or physical relation , provided or made available, or that You obtain after the date You starts Your initial relation with me, to the extent that such items are not accompanied by a separate license agreement or terms of use. BY PROPOSING, MARRYING,DEVELOPING RELATION, ACCESSING OR OTHERWISE USING THE PROFILE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT YOU HAVE NO RIGHTS TO THE USE THIS PROFILE AND SHOULD NOT PROPOSE,REFER, ACCESS OR USE THE PROFILE.
The RELATION[Marriage relation ] in the below terms may denote the MARRIAGE/RELATIONSHIP that may incur in future on basis of mutual agreement to the same.
The Relation is protected by INDIAN GOVERNMENT LAWS OF MARRIAGE [HINDU SPECIAL ACT] laws as well as other COMMUNITY level laws.Relation is licensed and not sold.
1. GRANT OF LICENSE. Myself grants You a non-exclusive, nontransferable license to refer and use the profile, subject to all the terms and conditions set forth here within.
1.1. Single-Use Perpetual License. You may permit a single authorized end user to develop relationship with me on a single life term for use by that end user only. Remote access / Relationships beyond overseas is not permitted without the express written consent of Me before agreeing.
1.2. Single-Use Term License. Same usage terms as the Single-Use Perpetual License except that the term of the license is limited to a fixed duration upon expiration [may be accidental/death and by legal terms ] of which the relation must be de-refereed unless the license is renewed for an additional period of time.
1.3. You may ask me for permission to have sole use and distribution of Relation. You may get written permission by dropping me a letter. After You receive written permission from me in an e-mail or letter, then 1.1 and 1.2 above do not apply.
2. ADDITIONAL LIMITATIONS. You may not reverse relation,broke, decompile, or disassemble the marriage relation, except and only to the extent that it is expressly permitted by applicable law notwithstanding this limitation. You may not rent, lease, lend or transfer the marriage relation, or host the marriage relation for third parties. The relationship is licensed as a single integral relation; its component values may not be separated for use on more than one family. It is illegal to make unauthorized usage of the relation. The relation may not be resold either by You or a third party person without the prior written permission of mine. All rights not expressly granted to You are retained by me.
2.1. Third Party Relation. The marriage relation may includes third party relation that I can grant sublicense to use and which is also protected by common law and other applicable laws.
3. SUPPORT AND MAINTENANCE TERMS AND CONDITIONS.
3.1. Term of Maintenance. I agrees to provide Maintenance (as defined herein),Peace,Careness,Wealth, Health, and a high Friendship to You pursuant to the terms and conditions set forth herein provided that You pay the peaceful relation for each n for which Maintenance is desired and as further described in Section 3.4 below. Maintenance will be provided for a period of life term, unless otherwise agreed to by the parties in writing, from the date of initial relation. Failure to the terms may result in broke of the marraige bond.
3.2. Maintenance Services. In exchange for the Maintenance , I agrees to provide to You during the term of this Agreement support and maintenance (collectively "Maintenance") as follows:
3.2.1. Peace: I will provide peaceful relation and support to You. I will investigate all of Your questions and problems promptly.As of after understanding the problems , I try to solve them at my best in peace full manner.I promise , You may enjoy peaceful life with me. The term PEACE may vary to everyone and here it denote what BUDDISHIM denotes. You agree to provide adequate information to me to assist in the investigation and to confirm that any problems have been resolved. I does not provide guaranteed response time but will make good faith effort to answer within twenty-four (24) hours or less during weekdays, excluding holidays.
3.2.2. Maintenance: I will supply to You, at no additional terms, any improvements, or modifications to the relation that I makes generally available. Any such improvements, or modifications shall become part of the existing relation for all purposes of this Agreement.
3.2.3. Careness : I promptly take care of You in terms of Physical , Mental , Psychological, Social,Religional , but not limited to the above. It is promised that , from scale of small sickness [that includes sneeze too] to high level of killer cancers [Blood , Brain tumors too ] , a high level alerts and care is taken from myside.It is also my duty to save the relation between us spending more time and careness to You.
3.2.4. Wealth : As a man, It's my responsibility to earn for the expense of family that needs to run day to day life , and/on to celebrate special events/occasions not limited to week end outing, picnics, travel, trips, religional [Diwali,Vinayagar saturti ,Sarawathi pooja,Navarathri], Regional [Pongal,Aadi events],Lingustics [Tamil new year], National [Independence,Republic,Gandhi jayanthi] , social , family , friends , personal [birthdays,special days] and celebration of new relations that not limited to babies, that might resulted as relation.
3.2.5. Health : This may appear as duplicate of Careness in this same section , but differed in terms sensitiveness. Careness is provided by myself when at lonely , Home and places where I can do my best. Health deals with what I can go further. I promise to insure Your Health against cases , that includes existing cases[this must to be notified earlier] and new ones possibly to develop.The insurance is not just limited to you, but includes the first level of blood relation [your siblings,your parents] and child/children that represent the relation.This may further extended/modified as stated above prior to written statement.
3.2.5. Friendship : The relation is not just limited as a marriage kinda of social , but values the humanly nature inside You , and try to make it best to sustain.It is promised that at any time [from early morning to late mid-nite] You can treat me a your close friend , spare time, disclose your secrets [even about the marriage relation.However this cannot be affect the primary marriage relation anyhow.This is some kind of virtual relation, that is closed FRIENDSHIP relation with MARRIAGE relation].You are also liberated to continue your existing friendship and to develop new one, unless it brought impact to the primary marriage relation.
You acknowledge and agree that the Maintenance to be provided by me hereunder is limited to the most valueness of the relation and the immediately preceding one.
3.3. Exclusions. My obligation to provide relation is contingent upon proper use of the relation and full compliance with this Agreement. Moreover, I shall be under no obligation to provide Support/Relation should such services be required due to (a) failure to operate the relation within (b) any modification or attempted modification of the relation by You or any third party or (C) Your refusal to accept Relation changes recommended by me.
3.4. Consideration. In payment of the services to be provided by me hereunder, You shall pay or at-least expected to provide care,kind,peace,time for the Initial relation and Maintenance as indicated. At the end of the Initial relation and Maintenance Term, or any subsequent relation and Maintenance , You may enjoy your marriage life as stated and/or governed the terms and laws above. The services provided shall be moreover equal to the services expected .
4. SERVICE TERMS. Unless explicitly set forth in this Agreement, all services and other due under this Agreement are non-cancel able and non-refundable.That is time spend is not promised to be spend after the cancellation. Unless otherwise agreed to by the parties, You shall pay all service to me at life term. A late service shall be charged on any overdue service and any others and expenses not included as provided under this Agreement at the rate of one and one-half percent (1%) per service, or the highest rate allowable under applicable law, whichever is less, commencing with the date service was due.That is as sample if You failed to spend 2 hour on a commited vacation or trip or any outer/inner date, You are expected to spend three Hours in additional to the day-to-day service as planned.
5. CONSENT TO USE OF SERVICE AND RELATION. If I provides any support services to You, You agree that I and my affiliates may collect and use all information You provide as a part of any such support services related to the relation hence forth we develop by agreeing. I agrees not to use this information in a form that personally identifies You.
9. WARRANTY
9.1. Warranty. Myself warrant that for a period before the date of initial relation (Marriage Date), under normal case, I am free from any kind of addictions not limited to Cyber [includes internet,social networks,emails,second life],Television,DRUGS,Tobacco[in form of Cigarettes,Cigar,Beedi], Alcohol [Brandy,Beers,Whiskey and common form of LIQUORS available in Indian market],Cocaine [In form of Coffee and Tea].The excluded one is somehow Bookholic.It is also noted that the latest MASTER HEALTH CHECKUP from Apollo [UHID AC05.000000157490] clears that I'm free from any major/minor disease carried out. Carefully mind that myself in past undergone a procedure for CSOM and it still has impact over ENT [Ear,Nose and Throat]. For further details on this , you may contact me directly.
9.2. Disclaimer. Other than the warranty set forth in Section 9.1 above, and to the maximum extent permitted by applicable law, I provide the Relation and any support services related to the Marraige AS IS AND WITH ALL FAULTS, and hereby disclaim all other warranties and conditions, either express, implied or statutory, including, but not limited to, any implied warranties, duties or conditions, of fitness for a particular purpose, of accuracy or completeness of responses, of results, of workmanlike effort, of lack of diseases, and of lack of negligence, all with regard to the Relation, and the provision of or failure to provide support services.
10. LIMIT OF LIABILITY AND EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER ACTIONS THAT BROKE RELATION. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL I AM BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL ACTIONS WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR PERSONAL INTERRUPTION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY, FOR FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE, FOR NEGLIGENCE, AND FOR ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE RELATION, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS LICENSE, EVEN IN THE EVENT OF THE FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT OR BREACH OF WARRANTY OF MINE, EVEN IF I HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.1. LIMITATION OF LIABILITY AND REMEDIES. Notwithstanding any actions that You might incur for any reason whatsoever (including, without limitation, all actions referenced above and all direct or general damages), the entire liability of mine, its resellers and their subsidiaries under any provision of this License and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You for the relation. The foregoing limitations, exclusions and disclaimers shall apply to the maximum extent permitted by common IPC law, even if any remedy fails its essential purpose.
11. GENERAL. This Agreement will be governed by and construed in accordance my own terms and might be risky to change in future.But any how aim of these terms is to develop STRONG relation that can last life long. But at any un-avoidable circumstances, You are liberated to break this relation, and it is promised that no more hurtful questions will thrown-ed at you.After that also friendly relation will maintained with You, one and only if you wish.
